The Court of Appeal,Ibadan Division through its judgement delivered on Monday,28th November,2022 has reinstated the gubernatorial candidature of Hon. Oladipupo Adebutu by setting aside the judgement of Olabode and others(Jimi Lawal's group) delivered by Justice O. Oguntoyinbo,on 27th September,2022,which ordered fresh rerun.The Court ruled that Olabode Idris and others had no locus standi to challenge the gubernatorial candidate primary election that produced Adebutu,because they were not aspirants based on electoral acts.The Court agreed with the appellant that Justice Oguntoyinbo, went in error to have entertained the matter.The Court also ruled all appeal in favour of appellant (PDP) sets aside the judgement of Justice O.Oguntoyinbo and also sets aside all the orders in the Federal High Court judgement of 27th September,2022.
In a swift reaction,the Jimi Adebisi Lawal Campaign Organization,has vowed to exercise their right of appeal at the Supreme Court.In a statement sent out by Austin Oniyokor,the project director of the group,'We just got the news of the decisions of Court of Appeal sitting in Ibadan,in respect of CA/IB/411/2022 and CA/1B/411A/2022.Although,the outcomes went against our wish,we are comforted that judicial process allows for appeal up to Supreme Court and we do intend to exercise our right of appeal.Recall,that our friends also appealed to the Supreme Court,when we (won) defeated them at the Court Appeal in Abuja,on 30th of September,2022,culminating in the judgement given in our favour by Supreme Court on 21st of November,2022.Flowing from the above,our legal team has taken steps to file stay of execution and notice of appeal.
